Bill OK'd requiring search warrant for email

The Senate Judiciary Committee Thursday approved legislation that would require police to obtain a search warrant from a judge, and not just a subpoena from a prosecutor,?before accessing the content of all emails and other private information from Google, Yahoo and other Internet providers. Under the current law, the 1986 Electronic Communications Privacy Act, a warrant is needed only for emails less than 6 months old.

The full Senate is expected to vote on the legislation next year.

"This is an important gain for privacy," said Chris Calabrese, legislative counsel for the American Civil Liberties Union, in a statement. "We are very happy that the committee voted that all electronic content like emails, photos and other communications held by companies like Google and Facebook should be protected with a search warrant.?We believe law enforcement should use the same standard to search your inbox that they do to search your home."

Still, the bill won't keep federal agents from combing through your inbox if they believe a crime has been committed, legal experts say. Federal and state authorities still will have a robust set of tools to track down lawbreakers even as these officials oppose changes supported by a broad coalition of technology companies and public interest groups.

Supporters of the bill, sponsored by Judiciary Committee Chairman Patrick Leahy, D-Vt., say the changes are necessary to overhaul a law that is outdated in an era of cloud computing, cheaper electronic storage, social networking and wireless phones. Such advances in technology have dramatically increased the amount of stored communications in ways no one anticipated a quarter of a century ago.

The approval is "a major step forward in efforts to reform the Electronic Communications Privacy Act The current law must be updated to address the tremendous technological advances that have taken place in the last 25 years. Congress must ensure that information Americans store in the cloud receives the same level of protection as the information stored in their homes," said?David LeDuc, senior director of public policy for the Software & Information Industry Association trade group.

The Justice Department has resisted the changes. The associate deputy attorney general, James Baker, urged the committee last year to consider the adverse impact on criminal and national security investigations if a warrant were the only means for law enforcement officials to obtain emails and other digital files.

But setting the bar higher doesn't prevent law enforcement agencies from doing their jobs, according to current and former prosecutors, judges and attorneys who specialize in privacy issues. Federal law enforcement authorities in four Midwestern and Southern states have been working with the more demanding warrant requirement since 2010 after an appeals court ruled warrantless access to emails was unconstitutional. To get a warrant, a judge must have proof of probable cause that a crime is being committed.

"I don't see anything (in the Senate bill) that's going to seriously concern law enforcement in terms of our ability to request warrants and to get the contents of the material that we need," said Joseph Cassilly, the state's attorney in Harford County, Md., and a former president of the National District Attorneys Association. "Since you've already got to get warrants for the stuff that's less than 180 days, it's obviously not an insurmountable standard."

Nor does the legislation weaken other methods used by law enforcement for collecting electronic information. A subpoena signed by a federal prosecutor ? not a judge ? will continue to be sufficient for obtaining routing data from third-party Internet providers that can identify the sender of an email and the location where the message was sent.

Police also can use what is known as a "D order" to get the "to" and "from" addresses of an email, but not the contents. These orders must be issued by a judge, but the agency seeking one need only show there is reasonable suspicion of a crime ? a lower legal standard than probable cause.

In a Nov. 21 letter to Leahy, 30 former federal and state prosecutors and judges said the bill would provide "a much needed judicial check on when the government can access our private digital information." Concerns that the bill would keep law enforcement from acting quickly during emergencies are unfounded, they added, because the Senate bill does not change a provision in the existing law that compels third-party providers to give the government information in situations where lives are at risk or children are being exploited or abused.

Digital Due Process, a wide-ranging coalition that includes Google, Microsoft and Twitter, as well as the American Civil Liberties Union and Grover Norquist's Americans for Tax Reform, has mounted a public relations campaign supporting the Senate bill. The coalition says updating the law will clear the "murky legal landscape" for companies and consumers alike and provide the proper safeguards for the vast amounts of information stored in server farms.

There's money at stake, too. The global market for cloud computing via the Internet is estimated to be $240 billion by 2020. But the Business Software Alliance, a coalition member that represents Apple, Intel and Microsoft, said U.S. cloud providers are at a disadvantage unless online privacy and security laws are changed. If consumers aren't sure their information is being properly protected on the remote, networked computer servers that make up the cloud, they'll take their business elsewhere.

Use of the law has been interpreted inconsistently by the courts, further fuel for those pushing for an overhaul. In a 2010 decision, the 6th U.S. Circuit Court of Appeals in Cincinnati ruled that an Ohio businessman's constitutional rights were violated when federal investigators obtained thousands of his emails without warrants. Now investigators in states covered by the 6th Circuit ? Ohio, Michigan, Kentucky and Tennessee ? must obtain warrants for all emails. But that's not the law in other federal circuits.

In the 9th Circuit Court of Appeals, which covers California, Washington, Oregon and six other Western states, judges ruled that a search warrant was required for both opened and unopened email, but only if left on a server for less than 180 days. The Justice Department has argued that a search warrant is required for unopened email left on a server for less than 180 days, but not for opened email less than 180 days old.

The decisions mean different rules apply depending where an investigation begins. How should emails be treated if a case starts in Pennsylvania and the messages are stored on a server in California, the hub for Google, Yahoo and other major Internet businesses?

"It's very confusing," said Hanni Fakhoury, a staff attorney at the Electronic Frontier Foundation in San Francisco. "Law enforcement will never admit this, but a uniform search warrant standard is easier for them."

Bloomberg first to deliver China Interbank FX rates globally | FX-MM

Bloomberg today announced the first global, real-time data service that provides investors access to live interbank pricing for China?s onshore renminbi (CNY) market. This service captures currency trading activity among banks and financial institutions in China, and is provided through the China Foreign Exchange Trade System (CFETS), the official interbank trading and foreign exchange (FX) division of China?s central bank.

Bloomberg logo?The addition of the CFETS data gives investors insights into real-time tick-by-tick movement, volumes and market participant information in China?s onshore interbank market,? said Tod Van Name, Bloomberg?s Global Head of FX, Economics and Commodities. ?Given the rapid internationalisation of the Chinese Yuan, this data is imperative to global markets as it provides our clients greater transparency for smarter and more timely trading, hedging and investment decisions.?

Global currency traders, corporate treasurers and institutional investors can now view executable quotes and trades on the interbank dollar-yuan spot, swap and forward markets. The CFETS data service also features the best renminbi spot prices from participating banks, historical trade sizes, and eight other renminbi currency pairs. Combined with Bloomberg?s FX suite, market participants can connect to global counterparties and liquidity, and access Bloomberg?s global FX trading community.

?The provision of real-time China interbank FX rates to international investors is yet another step in the right direction,? said Sam Phoen, head of global markets, ANZ bank (China). ?Onshore corporations and investors will benefit from real-time executable rates, while offshore players who are invested in China will have better visibility when hedging against movements of the renminbi.?

According to CFETS? publication ChinaMoney, with renminbi cross-border inflows and outflows intensifying in 2012, development of the offshore renminbi market will drive domestic financial market reform, and aid in a fair and transparent price discovery process for renminbi foreign exchange rates.

ACD Systems' venerable pro photo-workflow app has come in from ever more serious competition from the big guns Adobe and Apple, with extensive improvements in Lightroom 4 and Apple Aperture 3.3. But the latest ACDSee Pro 6 offers a lot for pro and serious amateur digital photographers, including integrated maps that work with geo-tagging, local adjustment brushes, and support for 64-bit CPUs for faster performance. And it is a responsive, enjoyable, and powerful pro photo tool that's less expensive than its nearest competitor, Lightroom. Despite all this, ACDSee Pro simply can't keep up with advanced features that media software giant Adobe includes in its digital photo workflow application.

Getting Started
You can download a free, fully functional 30-day trial of ACDSee Pro 6 to see whether it's your cup of photo-editing tea. It's Windows-only (sorry, Mac users), working from XP SP3 to Windows 8. Once you download its small installer, which handles the actual large download. The program size showed up in Control Panel as 177MB, compared with Lightroom's 835MB, so it will put less of a dent in your disk space. When you first run the app, a Quick Start Guide appears over the interface, offering to take you through a tour of its modes and tasks. This is a great help, considering the extensive number of modes, features, and tools in the program.

Like Lightroom, underneath ACDSee builds a database, or catalog to save all your image file preferences and edits. This means the originals, or negatives, are left untouched, so you can always revert to the photo's original state; you can save files containing your edits with the Export command.

Both editors also offer plug-ins, but there's a wider range of offerings for Lightroom?in fact, Adobe maintains an online plug-in-sharing section on its site for this. One important set of plug-ins that you can use in Lightroom, Photoshop, and Aperture, and Corel PaintShop Pro are those from Nik Software, which do things like precise sharpening and color effects and are a standard among pro photo editors.

Interface
ACDSee's interface always feels fast and fluid. Everything just works the way you expect it to, making switching between different activities intuitive. I had no trouble getting back and forth between organizing, viewing, and editing; even large camera raw files displayed quickly. Like Lightroom, ACDSee uses a modular approach: All this means is that there are big buttons that set up the app for the different types of tasks involved in the photo workflow process?importing and organizing, adjusting, enhancing, and outputting. Since I last evaluated ACDSee Pro, the module selection has changed, with Manage, View, Develop, Edit, and Online the current choices. Previously Develop and Edit were combined within the Process mode.

I mostly like ACDSee's mode options, especially splitting the manage and view modes, though I think a more generic output mode that included Print, rather than just online, would be preferable. And Lightroom outdoes ACDSee in the modes department by letting the user choose which modes should be available; that way if you, for example, never print photos, you can remove the Print mode.

Aside from this mode lock-in, the application's interface is very flexible: You can undock any panel so that it floats freely on your desktop, customize toolbars, and view in full screen.? It also makes extensive use of keyboard shortcuts for quick operation. You can change the photo background shade from the default dark gray, but not the overall interface from that same shade. Reset icons are everywhere, so if you goof, it's a cinch to get back.

Euro zone central banks may roll over their Greek bonds: document

BRUSSELS (Reuters) - Euro zone central banks may decide to roll over their holdings of Greek debt to reduce by 5.6 billion euros the amount governments will need to provide Athens by 2016, according to an document obtained by Reuters.

Such a move would cut the amount to 2 billion euros from 7.6 billion, the document, which emerged from this week's euro zone finance minister's meeting, showed.

International lenders -- euro zone countries, the European Central Bank and the International Monetary Fund -- agreed early on Tuesday on a debt reduction plan for Athens that would bring Greek debt to 110 percent of GDP in 2022.

This would be down from almost 190 percent expected for next year.

According to the document, Greece would need to get 1.8 billion euros in extra financing in 2012-2014 and another 5.8 billion between 2015 and 2016 -- a total of 7.6 billion.

But it floated the idea that if the euro zone's 17 national central banks, which together form the Eurosystem, decide to replace the Greek bonds they hold with new Greek paper as the debt matures, it would save Greece the need to redeem 3.7 billion euros in 2012-2014 and 1.9 billion euros in 2015-2016.

It lists the item of "roll-over of ANFA holdings" -- a term to describe central banks' investment portfolios -- in parenthesis, suggesting it has yet to be agreed or in any way formalized.

Furthermore, it notes that the amounts mentioned are tentative and subject to approval by national central banks.

There is no public data on the amounts of Greek debt held by individual euro zone central banks.

HELPING ATHENS

The roll-over idea is separate from the issue of the European Central Bank returning profits to Athens from the Greek bond portfolio it has acquired under its Securities Market Programme (SMP.

That will reduce the financing needs of Greece by 4.1 billion euros in 2012-2014 and another 3.0 billion in 2015-2016.

This return of profits -- along with cutting interest on euro zone loans to Greece, a deferral of interest payments, maturities extension, and several other measures -- allowed the euro zone to cut the amount of new money it would have to lend to Greece to 7.6 billion euros from 32 billion euros.

A roll-over of the Greek bonds in investment portfolios of central banks would increase the overall Greek public debt by 0.1 percent of GDP in 2020 and 2022.

But this would be offset by new debt relief measures penciled in by international lenders for the coming years that would cut Greek debt by 2.7 percent of GDP by 2020 and 5.1 percent of GDP by 2022, the document said.

This new debt relief could happen once Greece reaches a primary surplus -- a positive budget balance before servicing debt -- and if Greek reforms are on track, euro zone finance ministers decided on Tuesday.

AMAZON: We Doubled Kindle Sales - Business Insider

Amazon has another (pretty much) informationless press release out about Kindle sales this morning.?

The closest thing we get to real data: Worldwide Kindle sales over the holiday shopping weekend were more than double last year's sales.?

Awesome! Right?

Well, we have no clue because Amazon has never revealed absolute Kindle sales numbers. For all we know, Amazon sold 10,000 Kindle tablets and e-readers over the weekend.?

Amazon regularly puts out press releases like this. It brags about the Kindle being the best-selling item on Amazon.com, but doesn't say what that really means.?

It sounds good, so people assume Kindle is kicking butt.?

But, over the weekend, IBM released data on holiday shopping traffic on tablets. Surprisingly, Barnes & Noble's?Nook family had more tablet traffic than the Kindle family. Both of them were getting clobbered by the iPad, which had 88 percent of tablet shopping traffic.?

While we don't have any hard numbers about the Kindle's success, we assume it's meeting the company's internal goals because it has been expanding the line up every year since Amazon introduced the Kindle.?

Forget piracy. The music industry?s biggest money-loser is an inability to connect with older people that used to spend money on music, and don?t anymore.

I had a long call with people I work with, and I had ideas about finding my way to new listeners. Having this excellent second-act career, as a middle-aged artist, making singer-songwriter music that some Soul Coughing fans don?t like?and, pointedly, vice-versa?I want to get in front of the audiences of other artists with listeners in their late 30s, 40s, early 50s; to generally find older people that would like the songs. I?d like to widen my audience.

They were all ears?as was I, to their ideas. My agents (at High Road) and my management (Hornblow) are samurais. Unfortunately, our business is utterly focused on strategies to get music in front of people in their teens and 20s. Other than pushing what worked on younger people, and complaining that those avenues are ineffective with those same fans as adults, the bulk of our business isn?t TRYING to reach older listeners. However skilled, there?s only so much rain my peeps can make, without a wider culture built to help.

You get told that adults aren?t interested in music. That?s bunk. People who like art don?t stop liking art. They go to movies. The film industry makes a lot of money on blockbusters that young people love, but they also make money on subtler, artier stuff, that adults like, in a way that the music business hasn?t figured out.

If you put on an awesome rock record, singer/songwriter record, 80s/90s-style hip-hop record, middle-aged (let?s begin by being unafraid of that term) adults will dig it.

Shopping and Product Reviews: Will Traditional Shopping Die

The popularity of online shopping has been seen by many as a threat to the existence of traditional shopping. Their argument is based on the recent widespread closure of established brands like Sears and Best Buy. But can we really say that traditional shopping is dying?

In 2011, even though the U.S economy was sluggish, shopping grew by 15% over the previous year. In addition, about 35% of Americans now have smartphones which enable them to purchase goods and services over the internet and this figure is expected to rise significantly in subsequent years. In actual fact, about half of smartphone users have used their phones for one purchase or the other. On Christmas day of 2011 alone, about 6.8 million iOs and Android smartphones were activated. Top internet retailer, Amazon, recorded a whooping net sale of $48.08 billion in 2011 which represents 40.6% increase over $32.20 billion recorded in 2010. This figure is expected to rise in 2012 and subsequent years. What then is the implication of all these to physical retailing?

Since many people now decide to shop over the internet due to the benefits derivable in doing so like convenience, easy access to market, price comparison, avoidance of crowd, better prices and so on, can we really say that that the traditional way of shopping is being threatened? In my own opinion, technology will enhance the traditional method and not kill it. The popularity of video cassette recorder (VCR) in the 80's was seen by many as a threat to movie theaters then, but today, the film industry has been strengthened by the new technology and the demand for films has increased.

Moreover, when the email became very popular, a lot people thought that the traditional postal service would die, but today, it is waxing stronger. The point I'm driving at here is that, if traditional shop owners can embrace new technology, shopping on the internet would not be a threat to them but a blessing.

If physical retailers can monitor shopping behavior through the use of Wi-Fi signals from smartphones, they would be able to compete favorably in a fast-changing world. They can use technology to measure loyalty, make better staffing decisions, improve store layouts, reduce wait times in checkout lines and so on. Online shopping has come to stay but it is not a threat to traditional shopping because many consumers still value some of its features like quality of customer service, the experience of trying and buying products, how products are displayed and so on.

Local Real Estate Investment Madness | Mr. Money Mustache

The real estate market has been pretty interesting in my area in recent months, and perhaps in yours as well. It?s a topic worthy of discussion on this blog, since many of us consider property ownership to be a key part of our early retirement strategy.

If you live in an area where houses are currently expensive (San Francisco, Vancouver, New York, London, good slices of Canada and Australia, and anywhere else enjoying a surplus of demand) you might be frustrated that even owning your own place seems out of reach. In such an environment, you can often rent a house or apartment for less than the mortgage interest and taxes/insurance/maintenance would cost on a similar space. If the rent vs. buy decision leans towards ?rent?, it usually means that buying extra properties for investment income is also a bad idea.

On the other hand, much of the US housing stock is still on sale, presenting favorable conditions for both investment and cozy living. In my own city as well as most of the Denver area, this is definitely the case. In other areas in the US Southwest, there are even better deals to be had. As long as this persists, I?m going to keep an eye out for investment opportunities and pick out some good ones. Just a few examples from the recent shopping list:

Property 1: Nice Neighborhood Fixer-upper

A house recently came up for sale literally right in my back yard (I can see its rooftop over the fence when I eat breakfast each morning). It is a 3-bedroom house with a full basement, 1200 square feet on the main floor, plus a huge yard. But it had been abandoned by the owners at some point via the ?jingle mail? process, leaving a bank to take it over and attempt to re-sell it. In fairly ugly condition, but with good bones and potential.

Asking Price: $165,000
Renovation cost to bring to nice condition: $25,000 ($10,000 actual cash for materials, $15,000 of unpaid DIY labor from me).
Potential Rental Income: $1600/month

I put in an offer on this place for $150k, figuring that after paying myself $50/hour for renovations and buying materials, I?d have $175k invested. Gross rental income (at $1600/month) would be $19,200/year, and operating costs (tax, insurance,maintenance) would be about $3000. This would leave me with a net annual return of 9.25% on the total ?investment?, or 10.125% on the actual cash outlaid, since the materials for renovation would only be $10k.

On top of that, the place could easily be resold after renovation for about $240k after selling costs, leaving me with a tidy $65k in capital gains whenever I eventually decided to sell it. On an hourly basis, you could thus consider the 300 hours I would spend renovating the place to be bringing in an income of over $250.00 per hour.

Sounds pretty good, right? People often complain that it is hard to get 7% after inflation, and here I can get 10% within 300 feet of my breakfast table! This is exactly why I find real estate so interesting.

Epilogue: Unfortunately, I was not aggressive enough on the bidding for this place and another buyer outbid me. But the education that came from doing the analysis was fun and useful anyway.

Property 2: Downtown Residential Double-Header

A good friend of mine found a sweet deal on a place just a block from the best downtown restaurants. It?s a historic little 2-bedroom place from the 1920s, in rough condition, but for the $131,000 he is paying, it is a bargain. He?s a carpenter, so bringing it back to life will be no problem, especially since he plans to live there. He is also putting a Financial Independence Ace up his sleeve, since this place can easily rent for $1300/month once he fixes it up. After expenses, this is even more than the 10% net income I could have earned on the place in my own backyard. Since this friend has been known to go on long journeys to other states and countries in the past, he can now use his new house to fund his lifestyle abroad, by simply renting it out before long trips.

But that?s just the background for Property 2. The place I was interested in was right next door to his. Currently owned by the same person that sold him his place, this is a nearly-identical 1920s historic house. But mine had a full basement instead of a crawlspace, and a second building at the back of the lot: a 1500 square foot concrete garage structure with a flat roof. Inside, this place is set up as a ?monster garage/man cave? arrangement with enviable workshop space as well as a kitchenette and bathroom with shower.

Both units are currently configured as rentals, with a stable tenant in the garage. Total income is a combined $2000/month. I put an offer in at $190,000 for this property, which would yield 10.5% net income, with the potential for much more once I got around to doing some much-needed renovations on both the house and garage, allowing much higher rents in the future (12.6% after accounting for renovation costs). The sellers did not accept my offer (yet), although their counter-offer came close, so these returns are almost within reach.

The fun in owning this property would be to team up with my friend to create a sparkling jewel in the heart of the city ? both matching houses would be restored and painted with beautiful colors, fancy front porches and deluxe landscaping. The downfall of this deal is that mine would always have a commercial feeling: not every family wants a 1500 square foot concrete building in their back yard, so future buyers would be limited to investors or people with a serious love for workshop space. (When buying rental properties, always consider the eventual exit strategy, rather than just the retirement income).

Property 3: A Downtown Landmark

Some other friends and I also toured a big old brick 2-story commercial building on the nicest block of Main Street. Built in the 1880s, this beauty has high ceilings and about 3800 square feet of rentable space (a 2600 square foot retail space on the main floor and a 1200 square foot 3BR apartment above). Plus a 2 car garage on the back alley and flat roofs which present amazing rooftop patio potential for the residential space. ?Potential rental income was about $3,500-$4,000/month in its current condition (two tenants are already in place), although that could rise considerably once the apartment is renovated. Asking price was $350,000.

This was more of a fantasy exercise, since the price is more than I could safely handle right now, commercial space can be subject to long vacancies, and I don?t yet know much about the business. But it was still neat to think that a person could own such a significant chunk of a historic downtown, for less than the price of a 1-bedroom condo in many cities.

On top of that, our downtown is undergoing a bit of a renaissance right now, including a city-funded rebuilding of the alleys behind the prime downtown blocks (including the alley behind this building within the next 12 months), which creates new pedestrian walking spaces and storefronts ? potentially increasing desirability of this building. On top of that, a major new high-end residential project just broke ground a few blocks north of here, which at $21 million is worth about as much as the rest of the downtown buildings?combined.?It is a speculative endeavor, but if it were undertaken with some confidence and patience (and without much leverage), this building could be a very profitable and fun investment as well.

The possibilities in real estate investment are endless if you enjoy the work. I am writing about these three examples just to give you a feel of the thought process you might go through if you were to evaluate places in your own area. All of this is made even more fun by the fact that Mrs. MM holds a Colorado real estate license, so we get quick access to information and commission-free sales for any deals we do ourselves.

Equally interesting is the idea of investing in properties in other cities. The deals in my area are reasonable, but people in Arizona, Nevada and many other places have access to houses with even better cashflow right now. I contacted one MMM reader/investor about the idea of buying a place in Las Vegas as a rental, and although he was duly cautious on my behalf, the deals sounded quite favorable. Another reader (who is also a friend) from Australia contacted me personally, asking if I might help him buy an investment place right here in Longmont, since that country?s market is sizzlingly expensive right now, yielding poor returns.

After we return from the winter trip, I will be more serious about getting the next investment house purchased. Although we don?t technically need the extra income for ourselves, I still love the idea of restoring old houses, improving neighborhoods, and generating good investment returns ? which can in turn be used for bigger projects (and bigger charitable donations) in the future.

Magnesium oxide: From Earth to super-Earth

The mantles of Earth and other rocky planets are rich in magnesium and oxygen. Due to its simplicity, the mineral magnesium oxide is a good model for studying the nature of planetary interiors. New work from a team led by Carnegie's Stewart McWilliams studied how magnesium oxide behaves under the extreme conditions deep within planets and found evidence that alters our understanding of planetary evolution. It is published November 22 by Science Express.

Magnesium oxide is particularly resistant to changes when under intense pressures and temperatures. Theoretical predictions claim that it has just three unique states with different structures and properties present under planetary conditions: solid under ambient conditions (such as on the Earth's surface), liquid at high temperatures, and another structure of the solid at high pressure. The latter structure has never been observed in nature or in experiments.

McWilliams and his team observed magnesium oxide between pressures of about 3 million times normal atmospheric pressure (0.3 terapascals) to 14 million times atmospheric pressure (1.4 terapascals) and at temperatures reaching as high as 90,000 degrees Fahrenheit (50,000 Kelvin), conditions that range from those at the center of our Earth to those of large exo-planet super-Earths. Their observations indicate substantial changes in molecular bonding as the magnesium oxide responds to these various conditions, including a transformation to a new high-pressure solid phase.

In fact, when melting, there are signs that magnesium oxide changes from an electrically insulating material like quartz (meaning that electrons do not flow easily) to a metal similar to iron (meaning that electrons do flow easily through the material).

Drawing from these and other recent observations, the team concluded that while magnesium oxide is solid and non-conductive under conditions found on Earth in the present day, the early Earth's magma ocean might have been able to generate a magnetic field. Likewise, the metallic, liquid phase of magnesium oxide can exist today in the deep mantles of super-Earth planets, as can the newly observed solid phase.

"Our findings blur the line between traditional definitions of mantle and core material and provide a path for understanding how young or hot planets can generate and sustain magnetic fields," McWilliams said.

"This pioneering study takes advantage of new laser techniques to explore the nature of the materials that comprise the wide array of planets being discovered outside of our Solar System," said Russell Hemley, director of Carnegie's Geophysical Laboratory. "These methods allow investigations of the behavior of these materials at pressures and temperatures never before explored experimentally."

Black Friday Activities: Post-Thanksgiving Alternatives To Shopping

In recent years, Black Friday has become a controversial post-Thanksgiving tradition. While the Seattle Times traces the origins of the name to shopkeepers getting ?back in the black? financially speaking, the busiest shopping day of the year has been taken to an extreme. Violence, greed, and even death have become part of the Black Friday culture.

In addition, Black Friday kicks off the most wasteful time of the year. The EPA reports that between Thanksgiving and New Years Day, families increase their household waste by 25% and add an extra million tons of waste per week to landfills. Gift wrap and shopping bags add four million tons of waste annually, much of which is produced and discarded in the coming months.

Some, like Salon's Andrew Leonard, believe that the culture surrounding Black Friday exacerbates this wastefulness and materialism. "There?s a point where healthy consumerism becomes out-of-control marketing-driven commodity fetishism," Leonard wrote last year. "There is a point in our culture beyond which camp and kitsch no longer make the least ironic sense, where consumerism loses its last mooring to civilization...that point is Black Friday."

Despite the madness, Black Friday actually musters little enthusiasm among the general public. According to Mother Nature Network, 70% of Americans think it would be a good idea for our culture to be less focused on spending and gift giving. In fact, a Women?s Wear Daily poll shows that 43% of the people who go shopping on Black Friday don?t even enjoy it.

Mother Nature Network suggests that with the $52 billion worth of merchandise purchased during Thanksgiving weekend 2011, 104 million families could have received a dairy cow from Heifer International. Some now argue that the lukewarm enthusiasm Black Friday garners is not worth engaging in the wasteful, consumerist tradition. As Barbara Damrosch writes in the Washington Post, "there?s nothing wrong with gift-giving, but finding more affordable, sustainable and economical ways to do it will make Christmas merrier."

WESTON (CBSMiami) ? Art Ginsburg, a culinary institution on midday TV newscasts for decades, died at his home in Weston Wednesday following a struggle with pancreatic cancer. He was 81.

Ginsburg ? who enticed viewers for decades with a can-do focus on easy weeknight cooking and the tagline ?Ooh! It?s so good!? ? was diagnosed just over a year ago. The cancer had gone into remission following early treatments and surgery, but returned earlier this month.

Ginsburg had an unlikely formula for success in this era of reality cooking shows, flashy chefs and artisanal?foods. With a pleasantly goofy, grandfatherly manner and a willingness to embrace processed?foods, Ginsburg endeared himself to millions of home cooks via 90-second segments syndicated to 125 local television stations around the country.

And though he published 52?Mr. Food-related cookbooks, selling more than 8 million copies, he was little known to the nation?s foodies and mostly ignored by the glossy magazines. That was the way he liked it.

?They?re on the?Food?Network. They?re getting a lot of national publicity. And they?re getting big money,? he said of fellow?food?celebrities during a 2010 interview with The Associated Press. ?I was always the hometown guy. I don?t want to be the super celebrity. When you need bodyguards, that?s not my deal.?

Ginsburg grew up in the meat business, and eventually started his own catering company. He made his television debut in 1975 in upstate New York on a local morning program. His?Mr.?Food?vignettes were syndicated in nine television markets by 1980. His popularity peaked in 2007, when he was appearing on 168 stations.

He also was generous with the enviably broad reach of his culinary pulpit, frequently inviting up-and-coming celebrities to do guest appearances with him.

?Art Ginsberg was a warm, gregarious man who knew?food?is more about love and sharing than a fancy ingredient list,? said Rachael Ray, who Ginsburg invited on air long before she was a huge celebrity. ?He was a supportive and loyal friend and I?ll miss his smile and warm hugs. This Thanksgiving I?m thankful I knew him.?

In recent years, Ginsburg eased his involvement in the day-to-day operations of the company he founded, Ginsburg Enterprises Incorporated, which produces the television segments and oversees his many other ventures, including a line of housewares. The company also produced television segments that did not star Ginsburg, billing them as the ?Mr.?Food?Test Kitchen.? It plans to continue producing and syndicating those segments.

The Hands Off Approach to Grooming New Leaders | Luckett&Farley

As President and CEO of Luckett & Farley, one of the biggest challenges I face is finding the sweet spot when it comes to mentoring our future leaders. It?s a fine line?between being too distant and being just??hands off? enough to allow our rising stars to gain valuable experience in dealing with the myriad of difficulties that our profession offers.

In many instances, employees come to me wanting an answer to a problem or for me to step into a situation they may be having with a co-worker, vendor or client. When that happens, I rarely accept the ?upstream delegation.? Rather, I try to coach them in taking the next step(s). Some of the younger employee-owners aren?t used to this approach and have remarked that I?m not being helpful enough. What I believe some of our Gen Y-ers might be expecting is the ?mom and dad? response of swooping in and making everything better. That kind of response helps no one. So yes, I?m hands off.

Does this cause problems? You bet. But more importantly, it serves as long term learning experiences that give our rising stars increasing levels of confidence and helps tee-up problem-solving skills for the next time they?re needed.

I think leadership development can, at times, be an extremely messy process. And it?s certainly not a linear progression. How is a strict hands-on approach going to prepare our future leaders?? As my kids might remark: fail!

Many of the younger generation seem to initially want problem-solvers to rescue them. I?d rather coach them to a solution. If Plans A, B and C all fail then I suppose I?d directly step in, but I haven?t had to yet. That?s a testament to the leadership culture and our rising stars at Luckett & Farley.
